GENERAL TRAVEL TERMS AND CONDITIONS

Gulliver Destination Management Company d.o.o. undertakes to respect the privacy of all its passengers and will not make their data available to third parties or use it for marketing purposes without prior approval. Hrvatski klub putnika collects only the necessary user data required for the execution of the reservation.

All user data is strictly kept and is available only to employees who require such data to perform their duties. All employees of Gulliver Destination Management Company and business partners are responsible for adhering to the principles of privacy protection.

General Terms and Conditions for Package Travel – Gulliver Destination Management Company d.o.o.
 

1. GENERAL PROVISIONS

1.1. These General Terms and Conditions and instructions for the provision of travel services (hereinafter: General Terms) form an integral part of the package travel program (hereinafter: package) and the Package Travel Contract (hereinafter: contract or travel contract) concluded between the travel agency Gulliver Destination Management Company d.o.o., Obala pape Ivana Pavla II 1, 20000 Dubrovnik, OIB: 05162368387 (hereinafter: Gulliver Destination Management Company d.o.o. or the Organizer), or the retailer/seller of the package, and the traveler (hereinafter: the traveler), as well as the contract for the purchase of other travel agency services.

1.2. The terms used in these General Terms have the meanings established by the Act on the Provision of Services in Tourism (Official Gazette 130/2017), unless expressly indicated otherwise.

1.3. Terms used in these General Terms that have a gender-specific meaning apply equally to both male and female genders.

2. GENERAL TERMS FOR PACKAGE TRAVEL

2.1. Package Travel Contract

2.1.1. These General Terms apply to package travel organized by Gulliver Destination Management Company d.o.o. and to packages of other tour operators mediated by the company. The general terms of Gulliver Destination Management Company d.o.o. shall apply unless otherwise specified in the travel contract. For packages where Gulliver Destination Management Company d.o.o. is not the responsible organizer, the general terms of the responsible organizer shall apply, and Gulliver Destination Management Company d.o.o. is not liable for their implementation.

2.1.2. The Tour Organizer is the travel agency designated as such in the travel contract and guarantees the implementation of the published program according to the package content.

2.1.3. In the event that the contract, special business conditions, or an individual program stipulates otherwise regarding any point of these General Terms, the order of precedence is: the contract, followed by the travel program, then the special conditions, and finally the General Terms.

2.1.4. In the case of telephone or internet sales, the traveler is considered to have accepted the provisions of these General Terms at the moment they ordered the package. The traveler is obliged to familiarize themselves with the General and Special Terms published on the website www.gulliver-dmc.hr, or any publicly accessible website where Gulliver Destination Management Company d.o.o. enables the purchase of its own or mediated packages.

2.1.5. A traveler is any person wishing to conclude a package travel contract or who is entitled to travel based on a concluded package travel contract.

2.1.6. All information and conditions in the program and these General Terms are binding for the Organizer and the traveler, unless otherwise specified by the Contract.

2.2. Registration (Booking)

2.2.1. Registrations for packages offered by Gulliver Destination Management Company d.o.o. can be made at the company’s office, at authorized sub-agents, or via e-mail, regular mail, telephone, or the internet. Upon registration, a contract will be concluded, which also serves as a booking confirmation. The traveler must provide all required data/documents and pay the deposit and booking fees.

2.2.2. Based on the registration, the Organizer will offer a Contract, which becomes binding once signed or clearly confirmed (internet, e-mail, credit card details, payment). It produces legal effects once the payment is received by the agreed deadline. Unless stated otherwise, a 20% deposit is required upon signing, with the balance due at least 30 days before departure.

2.2.3. The traveler is responsible for the accuracy of the data provided. Any changes (e.g., name change due to marriage) must be reported to reflect the data valid at the time of travel.

2.2.4. Registration is binding. A contract is formed upon signature or payment of the package price.

2.2.5. A binding registration includes oral or written orders containing the names of travelers, payment instrument identification, or any "concludent action" confirming the traveler's intent.

2.2.6. Request (RQ) Bookings: For "on request" bookings, the traveler pays a deposit according to the organizer's cancellation scale (not less than 10%). If confirmed, it becomes legally binding.

2.2.7. Options: For "option" bookings, the terms on the option document apply. Options are not binding in cases of Force Majeure or "stop booking."

2.2.8. Online Sales: For internet purchases, these General Terms and the online offer apply. In case of discrepancies, the online version prevails. Full payment is a prerequisite for concluding a travel contract online.

2.3. Payment

2.3.1. The date of payment is the day the traveler pays at the cash desk or when the funds are recorded on the Organizer’s transaction account.

2.3.2. Failure to pay the price or any part thereof by the deadline is considered a cancellation of the travel contract.

2.3.3. Timely payment guarantees a spot in the program under the defined conditions.

2.3.4. Travelers must show proof of payment (voucher/receipt) to the tour leader; otherwise, they may be refused. The Organizer may refuse unannounced guests or charge them on the spot if space is available. Refunds, if justified, are made via bank transfer.

2.3.5. By paying the reservation, the traveler confirms they are fully familiar with the service characteristics and accept the General Terms.

2.4. Prices

2.4.1. Prices are published in Euros and are valid from the date of program publication.

2.4.2. The traveler must pay the base price plus all mandatory surcharges (taxes, fees) and any optional supplements.

2.4.3. Taxes, fees, or entrance fees determined by special regulations (which the Organizer collects on behalf of third parties) must be paid separately.

2.4.4. Price Increases: The Organizer may increase the price up to 20 days before departure if there are changes in: fuel costs/energy sources, taxes/fees imposed by third parties (tourist taxes, airport/port fees), or exchange rates. The traveler is entitled to a price reduction if these costs decrease.

2.4.6. The Organizer shall notify the traveler of any potential change in the travel price.

2.4.5. If the price increase exceeds 8%, the traveler has the right to terminate the contract and receive a full refund of the amount paid (excluding visa, insurance, or vaccination costs).

2.4.7. The Organizer is not responsible for services requested and paid for on-site to local providers.

2.4.8. Gulliver Destination Management Company d.o.o. may recommend in the program that the traveler pays for certain services, such as optional excursions, sports equipment rental, and similar, on-site. In such cases, Gulliver Destination Management Company d.o.o. acts neither as an organizer nor as an intermediary, but solely as an information provider. In such cases, the traveler may submit complaint claims exclusively to the executor or the service provider on-site.

2.4.9. Gulliver Destination Management Company d.o.o. may determine the package price in the program, explicitly stating that the price may be reduced if a certain number of passengers register or other precisely foreseen conditions are met. Such a provision in no way guarantees that the conditions for reducing the package price will occur, and the traveler has no right to withdraw from the contract because the conditions for a potential price reduction did not occur.

2.4.10. Potential discounts and benefits are always mutually exclusive and are never cumulative; in such cases, the traveler may choose the discount or benefit that best suits them and for which they meet the requirements. The discount is calculated exclusively on the part of the price excluding mandatory or additional surcharges, i.e., on the part from which tourist taxes, airport taxes, port fees, or similar, or additional special services (meals, excursions, transport, etc.) are excluded.

2.4.11. During the sale of an individual package travel, the Organizer may reduce the price of the package as offers titled Last Minute, First Minute, special offers, and similar, for the purpose of improving the sale of that package and without affecting already concluded contracts for the sale of that package.

2.5. Services Included in the Package Price

2.5.1. Unless otherwise specified in the program, the package price includes air tickets for economy class air transport, standard hotel rooms, and other services indicated in the travel program, as well as the organization of the trip. At the Traveler's request, the Organizer may offer a higher room categorization, a room with a view, etc.

2.5.2. If not otherwise defined in the program, the prices of an individual tourist package are valid per person and for accommodation in a double room used by two persons.

2.5.3. The content of the package consists of, or the package price includes, everything stated in the program. Certain special and additional services (transfers, additional meals, optional excursions, entrance fees, obtaining visas, vaccinations, travel insurance, tips, etc.) that are not included in the published package price, but which the Organizer can provide and include in the Contract, are paid for separately by the traveler. If the price of any of the requested services that the Organizer can provide is not stated in the program, the Organizer will inform the traveler of the price before concluding the Contract.

2.6. Special Services

2.6.1. Special services are those that are generally not included in the basic package price, such as a single room, special diet, optional excursions, and similar.

2.6.2. In the event that special or optional services are listed for an individual package, the traveler may express a wish for those services during registration and pay for them in addition to the basic package price. Published prices for optional or special services are valid only in the case of ordering and paying for these services at the time of ordering and paying for the basic package.

2.6.3. Optional excursions for which travelers decide and confirm to Gulliver Destination Management Company d.o.o. are considered a credible and binding confirmation, and according to the informative prices of optional excursions stated on the website of the trip itself, they should be paid upon arrival at the destination; changes to the choice of optional excursions, due to the inability of the local agency to refund money, can be made no later than 7 days before departure, except for optional excursions that must be paid in advance, because after confirmation by Gulliver Destination Management Company d.o.o. of their selection, subsequent change is not possible. The Organizer is not responsible for increases in the prices of entrance fees or optional excursions listed in the program on the day the program was formed.

2.6.4. Gulliver Destination Management Company d.o.o. does not oblige travelers on its group trips to have an obligation to purchase optional excursions. However, in the case when an optional excursion affects the realization of the travel program itself, as published on the official website of the Organizer, the traveler has an obligation to adapt to the majority and accept the advice of Gulliver Destination Management Company d.o.o. to decide in favor of that optional excursion after all. When 70% of the travelers in a group decide on an optional excursion, and 30% of the travelers in the group do not decide on the same optional excursion, then the minority must adapt to the majority and accept the advice of Gulliver Destination Management Company d.o.o. to decide in favor of that optional excursion after all. In the event that a traveler refuses to accept the advice and does not want to adapt to the rest of the group, Gulliver Destination Management Company d.o.o. may proceed with canceling the trip to the detriment of the traveler.

2.6.5. On trips organized by Gulliver Destination Management Company d.o.o., it is not allowed to use the services of other unverified local agencies for excursions at the destination, exclusively for the safety reasons of the traveler themselves. If it is established that the traveler used the service of other unverified local agencies for excursions at the destination itself, all other excursions for which they decided through Gulliver Destination Management Company d.o.o. will be automatically canceled, and due to harmful consequences and/or newly arisen problems on excursions outside the organization of Gulliver Destination Management Company d.o.o., i.e., in the traveler's own arrangement at the destination, Gulliver Destination Management Company d.o.o. bears no responsibility for them, i.e., the traveler fully assumes responsibility and joins the rest of the group at their own expense. In the event that due to the newly arisen situation the Traveler wishes to abandon the trip, in that case, they have no right to a refund of costs or the travel price, neither partially nor in full.

2.6.6. In the event that the Traveler, who did not decide on a certain excursion from the travel program, does not appear at the agreed place at the agreed time, it will be considered that the traveler has voluntarily deviated from the agreement and that they will reach the point of continuation of the trip at their own expense. In that case, the traveler has no right to a refund of costs or the travel price, neither partially nor in full, and is responsible for costs and damages caused to the Organizer or other travelers by changing the program. Gulliver Destination Management Company d.o.o. bears no responsibility for the newly arisen situation, i.e., the Traveler fully assumes responsibility and joins the rest of the group at their own expense.

2.7. Traveler's Cancellation or Change of Travel

2.7.1. The traveler has the right to cancel the trip. In the event that the traveler cancels the travel contract, Gulliver Destination Management Company d.o.o. has the right to compensation for costs incurred by the cancellation of the contract.

2.7.2. If the costs due to the cancellation of the travel contract are determined differently in the contract, program, or special conditions, the conditions determined by the contract, program, or special conditions shall apply.

2.7.3. The amount of the refund of costs for the cancellation of the package depends on the time period before the day the service starts in which the traveler canceled the travel contract.

2.7.4. If the traveler cancels the package, the Organizer retains from the total price of the package:

European trips:

  • from registration until 30 days before departure: 20% of the package price, but at least 150 EUR
  • 29-22 days before departure: 30% of the package price
  • 21-15 days before departure: 40% of the package price
  • 14-8 days before departure: 80% of the package price
  • 7-0 days before departure and after departure: 100% of the package price.

Long-haul trips:

  • from registration until 60 days before departure: 50% of the package price
  • 59-45 days before departure: 80% of the package price
  • 44-30 days before departure: 90% of the package price
  • 29-0 before departure: 100% of the package price.

One-day excursions:

  • from registration until the day before departure: 50% of the package price
  • the last day or 24 hours before travel: 100% of the package price.

2.7.5. If the actually incurred damage is greater than stated, the Organizer reserves the right to charge it, up to a maximum amount of 100% of the package price. The stated cancellation costs also apply to changes in the departure date and accommodation facility, i.e., type of accommodation unit, as well as to all other significant changes unless explicitly stated otherwise in the travel program or catalog. When canceling a package, the traveler has no right to compensation for potential visa costs, insurance, vaccinations, and similar costs.

2.7.6. In the event that Gulliver Destination Management Company d.o.o. is not the organizer of the tourist package, the following conditions apply when determining the amount of costs due to the cancellation of the trip, unless otherwise stated in the Travel Contract:

  • up to 45 days - 40% of the package price
  • 44 to 30 days before the day the service/trip starts - 60% of the package price
  • 29 - 0 days, including the day the service/trip starts - 100% of the package price.

2.7.7. If the traveler does not appear or cancels the travel contract on the day the trip starts or even after its start, Gulliver Destination Management Company d.o.o. or another organizer will charge the traveler for the entire value of the package.

2.7.8. When canceling a trip, the traveler must sign a cancellation statement that will be provided for signature by the seller. If the traveler refuses to sign the cancellation statement, it will be considered that the traveler did not cancel the trip.

2.7.9. During the trip, the traveler may terminate the trip at their own request by signing a termination statement. If the traveler terminates the trip during the travel, after returning, they have no right to a refund of costs or the amount paid, neither partially nor in full.

2.7.10. If the traveler, during the trip at their own wish, changes the program or does not travel according to the program which is an integral part of the travel contract, it will be considered that the traveler deviated from the contract during the trip. In that case as well, they have no right to a refund of costs or the travel price, neither partially nor in full, and are responsible for costs and damages caused to the Organizer or other travelers by changing the program.

2.7.11. In the event of changing the program at their own wish, the traveler has no right to demand any compensation or price reduction.

2.7.12. Before the start of the package, and after the conclusion of the contract, the traveler may transfer the package travel contract to a person who meets all the conditions applicable to that contract, if they have notified Gulliver Destination Management Company d.o.o. about it on a durable medium at least fifteen (15) days before the start of the package, and if such a change is permitted by the final service providers that make up the package. The traveler can change the name and number of passengers, accommodation, travel date, if such a change is possible without canceling the package. For every such change, the traveler is responsible to Gulliver Destination Management Company d.o.o. for the actually incurred administrative costs at least in the amount of 50 EUR.

2.7.13. The transferor and the transferee of the package travel contract are jointly and severally responsible for the payment of the price amount and for all additional fees, charges, or other costs arising from the transfer of the contract.

2.8. Insurance from Travel Cancellation Risk

2.8.1. According to the Act on the Provision of Services in Tourism, employees of travel agencies are obliged to offer all travelers a travel insurance package that includes health insurance during their stay abroad, insurance against the consequences of an accident, luggage insurance, and travel cancellation insurance. At the time of registration or at the moment of concluding the Contract, the traveler can pay only an individual insurance policy or the entire travel insurance package. Gulliver Destination Management Company d.o.o. recommends contracting travel insurance packages. Insurance policies can be contracted until the moment of departure, except for the travel cancellation insurance policy which can be contracted until the moment of concluding the travel contract, which also includes the travel insurance package containing travel cancellation insurance. The insurance premium is calculated taking into account the value of the travel service, and according to the price list of the insurance company with which Gulliver Destination Management Company d.o.o. has a signed mediation agreement. Gulliver Destination Management Company d.o.o. acts as a secondary intermediary in the sale of insurance policies.

2.8.2. If the traveler concludes insurance from the risk of travel cancellation with one of the insurance companies, the traveler's rights based on the cancellation risk insurance are claimed at that insurance company, whereby the general business terms of the insurance company apply. The course of resolving the compensation case and the time of resolving the compensation case is within the domain of the insurance company with which the insurance from travel cancellation risk was contracted.

2.9. Organizer's Right to Cancel the Trip

2.9.1. The Organizer may terminate the package travel contract before the start of the package and fully return all payments received for the package arrangement to the traveler, without the obligation to compensate the traveler for damages, if the number of persons registered for the package arrangement is less than the minimum number stated in the contract and if the organizer notifies the traveler of the termination of the contract within the period established in the contract, but no later than:

  1. 20 days before the start of the package for trips lasting more than six days,
  2. 7 days before the start of the package for trips lasting between two and six days,
  3. 48 hours before the start of the package for trips lasting less than two days.

2.9.2. The Organizer may terminate the package travel contract before the start of the package arrangement and fully return all payments received for the package arrangement to the traveler, without the obligation to compensate the traveler for damages, if the organizer is prevented from executing the contract by extraordinary circumstances that could not be avoided and if they notify the traveler of the termination of the contract without unnecessary delay before the start of the package arrangement.

2.9.3. In the event of contract termination from points 2.9.1. and 2.9.2. of this chapter, the organizer loses the right to the agreed price of the package arrangement and is obliged to return all payments made by the traveler to the traveler without unnecessary delay, and no later than 14 days from the termination of the package travel contract.

2.9.4. If not otherwise stated in the program or in the travel contract, the minimum number of passengers for travel on intercontinental airline routes is at least 14 passengers in an individual group.

2.9.5. Gulliver Destination Management Company d.o.o. may cancel the package or make program changes if extraordinary circumstances occur that cannot be predicted, avoided, or removed (war, unrest, strike, terrorist actions, sanitary disturbances, natural disasters, traffic accidents, sudden and unusual traffic jams, interventions of competent authorities, sudden changes in timetables, delay of aircraft and other means of transport, weather conditions, etc.), and which, had they occurred at the time of concluding the Contract, would have been a justified reason for the Organizer not to conclude the contract.

2.9.6. The Organizer particularly reserves the right to change the day and hour of departure due to a change in the aircraft timetable or the occurrence of other previously mentioned circumstances, as well as the right to change the direction of travel due to changed circumstances, without the traveler's right to compensation for damages or price reduction. The Organizer will immediately notify the traveler of every program change. The Organizer is not responsible for the delay of an airplane, ship, or train, nor for program changes and incurred costs conditioned by such delay. If circumstances at the destination itself prevent the accommodation of the traveler in the reserved facility, the Organizer will, at its own expense, accommodate the traveler in another facility of equal or higher category than the reserved one.

2.9.7. Gulliver Destination Management Company d.o.o. is not responsible for program changes due to the occurrence of any force majeure during the duration of the program. In these cases, Gulliver Destination Management Company d.o.o. will endeavor to provide services to travelers in a changed form taking into account the actual circumstances. In the event that Gulliver Destination Management Company d.o.o. cancels the trip, the traveler has the exclusive right to a refund of the entire paid package price. Gulliver Destination Management Company d.o.o. will immediately notify the traveler of every subsequent program change. If Gulliver Destination Management Company d.o.o. or another travel organizer cancels the contract during its duration, the traveler has the exclusive right to a refund of the price for the unused part of the agreed services. Likewise, the traveler has no right to a refund of administrative costs and the price of the insurance premium concluded with the insurance company. In the event that Gulliver Destination Management Company d.o.o. cancels the trip due to an insufficient number of registered passengers (the minimum number of passengers for a safe departure is 14), it does not refund the amount of the bank fee for card payment (commission for card payment and VAT on interest).

2.9.8. Gulliver Destination Management Company d.o.o. may cancel the contract or withdraw from the contract and demand payment of compensation from a traveler who does not adhere to the travel contract, primarily if the traveler intentionally gave incorrect data about the passengers and their age, or if changes occurred during the trip about which the traveler did not notify Gulliver Destination Management Company d.o.o..

2.9.9. The Organizer bears no responsibility if certain activities and contents that depend on weather conditions (low sea temperature, precipitation, storm, and similar) and natural phenomena (sea blooming, occurrence of insects, jellyfish, and similar), cannot be realized in accordance with the traveler's expectations.

2.10. Travel Documents and Other Traveler's Obligations

2.10.1. The traveler is obliged to inform themselves about the valid regulations on travel documents, visas, foreign exchange, customs, and health regulations. The traveler is obliged to ensure that they personally, as well as their documents and luggage, meet the conditions provided by border customs, health, and other regulations of their country and the country to which or through which they are traveling. A traveler registering for travel abroad must have a valid passport or another valid appropriate document with which they can enter a particular country throughout the entire trip, which are valid for at least 6 months from the day of entry into the country being traveled to or if otherwise stated in the program.

2.10.2. In the event that certain countries condition entry into the country with a certain temporal validity of the travel document before the expiration of validity on the day of entry, the traveler is obliged to take account of these provisions themselves. Gulliver Destination Management Company d.o.o. is not responsible for possible difficulties or forced interruption of the traveler's trip for such reasons.

2.10.3. The traveler is obliged to ensure that their documents and things fulfill the conditions determined by the carrier and those provided by border, customs, health, and other regulations of their country as well as the states through which or into which they travel, and the Organizer is not responsible for the decisions of officials by which a traveler is denied transport, refused the issuance of a visa or not allowed entry into a particular country, nor for costs arising as a result. If due to the previously mentioned reasons a cancellation of the trip occurs before or during the trip, the Organizer reserves the right to compensation for damages as determined by these General Terms.

2.10.4. When registering for the trip, the traveler is obliged to submit all necessary personal data identical to those from the valid travel document with which they will travel, which they give voluntarily, and which are necessary for the realization of the agreed trip, and that within 4 weeks from registration for the trip, or within 7 days from registration for the trip if the departure is within 60 days from registration for the trip. The Organizer is not responsible for newly arisen situations and costs arising due to untimely submitted, incomplete, or inaccurate data of travel documents with which the Traveler will travel and which are necessary for the realization of the trip.

2.10.5. Before the trip, i.e., by the deadline determined in the program, the traveler is obliged to obtain a visa for the countries they are traveling to and perform vaccinations that are mandatory for those countries. If the traveler does not fulfill the stated obligations, Gulliver Destination Management Company d.o.o. may cancel the travel contract. Gulliver Destination Management Company d.o.o. may mediate in its issuance, if it has contracted such a service with the traveler. Gulliver Destination Management Company d.o.o. does not guarantee the obtaining of a visa. Gulliver Destination Management Company d.o.o. will not refund the costs of obtaining a visa to the traveler. Gulliver Destination Management Company d.o.o. does not guarantee the accuracy of the information it received from the competent diplomatic representations and forwarded to the traveler. In the event of refusal of entry into a state or other restrictions, all costs are borne by the traveler themselves. Mediation by Gulliver Destination Management Company d.o.o. in obtaining a visa is not included in the price of the trip, but is paid separately. If the traveler did not submit the necessary documents for visa issuance to Gulliver Destination Management Company d.o.o. within the deadline determined in the program or offer, it is considered that they will take care of obtaining the visa themselves. Due to the requirements of international passenger traffic, the traveler is obliged to give all necessary data about all their companions during registration. Data must be fully aligned with the data in official documents that travelers are obliged to have with them during the trip, in accordance with the regulations for crossing the state border and relevant foreign legal provisions. In the event that incorrect data cause delay, additional costs, or interruption of the trip, the traveler themselves is responsible to other travelers for all incurred costs. The traveler is obliged to respect the house rules in catering or hotel facilities and cooperate in good faith with the representative of the organizer and the service executor. In the event of non-compliance with these obligations, the Organizer rejects any responsibility for the caused damage, and the traveler pays for it on the spot. It is a recommendation that every traveler also informs themselves personally on the website www.mvep.hr and looks at the list of states of high or moderate risk according to the opinion of the MVEP of the Republic of Croatia. We recommend all travelers who are not citizens of Croatia and do not have Croatian travel documents to inform themselves personally before paying for the arrangement about the country they are traveling to and the conditions that need to be met for travel to that country, having in mind the diversity of regulations valid for citizens of individual countries. Gulliver Destination Management Company d.o.o. may direct the traveler to the source of information, but in no way assumes responsibility for the consequences that might arise for the traveler themselves as a result of non-compliance with those regulations.

2.10.6. Costs and damages incurred due to the loss or theft of documents or other valuables during the trip are borne by the traveler. During the trip, the traveler is obliged to adhere to personal safety rules that every average person would use and apply due care. The Organizer is not responsible for the traveler's actions concerning their personal responsibility.

2.10.7. Hotel registration and entry into the room ("check-in") can be done after 14:00 h on the arrival day, and hotel checkout and leaving the room ("check-out") must be done no later than 10:00 h on the departure day. In cooperation with the hotel, the Organizer will try to ensure that the group checks in earlier than officially planned, depending on the availability and occupancy of the hotel on the check-in day.

2.10.8. Gulliver Destination Management Company d.o.o. has no obligation to join solo travelers in a shared room for the purpose of cost reduction. We will try to join all solo travelers with another solo traveler (by gender and age); if it is not possible, it is necessary to pay a supplement for a 1/1 room, and that no later than 45 days before the departure on the trip. In the event that a solo traveler still registers from 45 days before the trip until departure, Gulliver Destination Management Company d.o.o. will fully return the money paid for the single room supplement to the solo traveler who made the payment for the same. For joining solo travelers, the approval of both solo travelers is required. If the other traveler refuses joining with another solo traveler, Gulliver Destination Management Company d.o.o. has no obligations toward the other solo traveler, but the traveler must pay the 1/1 room supplement. Gulliver Destination Management Company d.o.o. reserves the right to still require a 1/1 room supplement if both solo travelers confirm joining. In the event that, despite the rooming list submitted by Gulliver Destination Management Company d.o.o., the hotel on the spot is not able to ensure the contracted room, Gulliver Destination Management Company d.o.o. is not responsible for it, and the traveler will be offered another option for accommodation that is possible at that moment, and in the event that the option offered to the traveler does not suit them, they should pay for the accommodation they want at their own expense.

2.10.9. If the traveler does not respect their obligations, they are responsible to the Organizer for the damage caused to them thereby. The Organizer bears no responsibility for the damage the traveler might suffer in such a case. During the trip, the traveler is obliged to behave in a way that does not endanger the lives or health of their companions and does not endanger the course of the trip. In the event that the traveler behaves contrary to this provision, the representative of the organizer has the right to exclude them from the further trip without a refund of any costs except for unused fees the traveler has already paid on the spot.

2.11. Notices before Departure/Travel

2.11.1. The Organizer or its intermediary are obliged to make promotional material and these General Terms available to the traveler in written or electronic form, and to give prescribed and appropriate information about the main features of the travel services, about the organizer and travel intermediary, the price of the arrangement, payment methods, data on basic travel characteristics, the minimum number of persons required for the realization of the arrangement and the deadline for sending notification that the required number of persons has not been reached, about the conditions of the destination country regarding passports and visas, about the fact that the traveler can terminate the contract at any moment before the start of the package arrangement upon payment of an appropriate fee for contract termination, about optional or mandatory insurance for covering the cost of contract termination by the traveler or the cost of providing assistance, including repatriation, in case of accident, illness, or death. By signing the contract, the traveler confirms that all this information was presented to them and that they are familiar with the content and the possibility of insurance.

2.11.2. Gulliver Destination Management Company d.o.o. does not send notices to travelers by regular mail before the trip, unless otherwise determined in the program. Travelers will receive notices before the trip at their email address if they indicated it during registration; otherwise, they can pick up the notices at their registration point where they will be available no later than three to five days before the start of the trip. Information that the traveler receives orally at the point of sale, by phone, in another way, or in writing from an unauthorized person, does not bind the Organizer to a greater extent in relation to the notices indicated in the travel program, these General Terms, and the Contract.

2.11.3. Photographs published on websites and in advertising materials are of an informative and non-binding nature.

2.11.4. The Organizer is not responsible for eventual printing errors nor for subsequent changes in new editions of advertising materials and programs about which the traveler was informed before the conclusion of the Contract, so in that sense, the data stated in the Contract, and not in the advertising material, are considered authoritative.

2.11.5. According to the regulations of the World Health Organization, for travel to certain states, the traveler is obliged to be vaccinated and obtain the appropriate document about the performed vaccination. Vaccination is also mandatory if a regulation of that type is accepted by signing the travel contract. The traveler is obliged to inform Gulliver Destination Management Company d.o.o. about all facts regarding their health, habits, and similar, which might endanger the course of the trip (if for health and other reasons they seek a certain type of food, suffer from a chronic illness, allergies, and similar). Upon receiving the request, Gulliver Destination Management Company d.o.o. will submit the traveler's request for a special type of diet to the airline company, i.e., hotels in the destination, but is not responsible for the non-fulfillment of the request in case they are not in a position to offer the requested type of meal, i.e., if an omission occurred in the organization of the sought request in the airline and/or hotel.

2.11.6. The organizer, agent, or intermediary is not responsible for the transport of luggage; they are not responsible for destroyed or lost luggage, nor for the theft of luggage and/or other valuables in the hotel or means of transport. The traveler must personally address reports of lost or damaged luggage to the carrier, hotel, or other direct executor of the service. For the transport of special luggage, such as, for example, bicycles, surfing or golf equipment, the traveler is obliged to pay additional costs to the carrier, mostly upon departure. In any case, the transport of such type of luggage must be announced already at registration. Regardless of the stated, due to limited capacity, the carrier in any case has the right to refuse the transport of such a special type of luggage. All costs i.e. damage that might occur because of that are borne by the traveler themselves. Gulliver Destination Management Company d.o.o. is not responsible for the theft or damage of the traveler's luggage or other personal things, valuables, and personal documents in accommodation facilities or means of transport. The traveler resolves questions of missing, damaged, or destroyed things directly with the direct provider of transport or accommodation services.

2.11.7. Transport of luggage up to a certain weight determined by the carrier is free of charge. The traveler themselves must pay for every additional kilogram on the spot in the appropriate currency, i.e., according to the rules of the carrier. Children up to two years of age do not have the right to free luggage transport. In air transport, only the airline is responsible for luggage. In the event of luggage loss, the traveler should submit the completed prescribed form to the airline representative and keep one copy for themselves. On the basis of that form, the airline can pay out compensation, in accordance with the regulations valid in passenger air traffic.

2.11.8. According to the rules of airline companies for group travel, it is not possible to do an online check-in for the flight; instead, check-in is possible exclusively at the counter at the airport. Gulliver Destination Management Company d.o.o. always submits the list of passengers to airline companies together with information about who is traveling in a pair and if there are special requests regarding meals on the flight. Gulliver Destination Management Company d.o.o. has no authority to do the seating arrangement in the plane, as that is exclusively within the competence of airline companies. If a situation arises where pairs do not sit together, then it is possible to seek a change during check-in at the airport or ask the flight attendant in the plane. Our leader will be at the travelers' disposal, but Gulliver Destination Management Company d.o.o. distances itself and is not responsible for the errors of the airline company. A complaint can be addressed directly to the airline companies.

2.11.9. Transport and accommodation of pets is not permitted, except exceptionally on request and with a surcharge.

2.12. Carrier Punctuality

2.12.1. Gulliver Destination Management Company d.o.o. reserves the right to change the timetable, types of aircraft, carriers, and flight direction (stops during the flight, flights through other airports, and similar) which may occur due to various technical and organizational reasons. Likewise, delays can occur, which are most often the consequence of air space overload, strikes, and bad weather; the organizer has no influence on them. The occurrence of these changes is not considered an amendment to the travel program because the first two days and the last two days of the trip are intended exclusively for arrival at the destination and departure from it and the associated transports, and not for vacation. The traveler is obliged to check the return time with the organizer's representative 24 hours before the return. For additional costs, unused services, and/or other damages caused by the delay of the air carrier, Gulliver Destination Management Company d.o.o. does not accept responsibility, and it is necessary to contact the airline directly for compensation costs.

2.13. Loss of Personal/Travel Documents

2.13.1. If the traveler's travel documents are lost or destroyed during the trip, and they are necessarily needed for the continuation of the trip or for the return to the state of departure, the traveler will obtain new travel documents at their own expense.

2.13.2. The traveler can turn for advice and help in obtaining new travel documents to the tour leader i.e. the representative of the travel organizer who will help the traveler in that case, while taking account of the regular course of the Travel Program.

2.13.3. If the traveler must interrupt the trip due to the loss or destruction of travel documents, they have no right to any refund of the paid trip or refund of costs.

2.13.4. Only the traveler is responsible for travel documentation (passport, airplane ticket) and obtaining a visa. In the event of incomplete, inaccurate, or changed personal data, the traveler is obliged to promptly notify Gulliver Destination Management Company d.o.o. Otherwise, if the sent data are not accurate, the traveler is responsible for all additionally incurred costs themselves. If the loss or theft of travel documents occurs during the trip, the traveler is obliged to bear the cost of obtaining new documents themselves, as well as all additional costs such as changes to the airplane ticket dates, transfers, overnight stays outside the regular program, and all other additional costs arising from the loss of travel documents.

2.14. Categorizations of Accommodation Facilities and General House Rules

2.14.1. Offered accommodation facilities, restaurants, means of transport, and other means of providing travel services are described according to the official categorization of the local tourist organization or another competent body at the time of the publication of the travel program. Standards of accommodation, food, and other traveler services of individual places and countries are different and are not always comparable.

2.14.2. House rules, food, services, the beach, as well as other hotel offers are under the supervision of local tourist organizations. The organizer has no influence on these elements.

2.14.3. In arrangements marked as all inclusive, it is suggested to carefully read the description of the service in the travel program, i.e., the offer or contract, because all all inclusive offers are not identical. Usually, the basic service in an all inclusive offer is full board, i.e., breakfast, lunch, and dinner, and drinks are included in the price along with meals.

2.14.4. If the traveler does not pay extra for a room with special characteristics during booking (sea view, balcony, position - orientation, a certain floor), they will be accommodated in one of the rooms that are officially registered for guest accommodation in the hotel. The room arrangement is within the competence of the hotelier, and the travel organizer has no influence on it. The organizer can relay the traveler's wishes to the hotelier but cannot guarantee that they will be fulfilled. Accommodation in single rooms most often does not correspond to the standard of a double room. When being accommodated in a triple room, the traveler must take into account that it is most often a double room with an extra bed, whereby the accommodation of the third person does not correspond to the accommodation standard of the other two persons. Usually, it is a fold-out bed which in size and comfort is not equal to a usual bed and is suitable for a child.

2.14.5. If the traveler has not exclusively contracted an accommodation unit (room, apartment, and similar) with special features, they will accept any officially registered accommodation unit for renting in the subject facility. Entry into the accommodation unit is usually between 16:00 and 20:00 h, and they usually must be vacated by 09:00 or 10:00 h on the day the service ends, unless otherwise determined by the house rules and the rulebook of the service executor, about which the traveler will be informed directly by the service executor during registration at the accommodation facility. In the event of arrival or departure from the accommodation unit that does not coincide with the time of entry and vacating the accommodation unit, the service executor will, in accordance with the business rules of the accommodation unit, provide appropriate space for the traveler for storing and keeping luggage but cannot guarantee the fulfillment of such a request. Gulliver Destination Management Company d.o.o. will inform the service executor about every pre-announced additional request of the traveler regarding the accommodation facility (stay of pets, baby cot, room orientation, room position, floor, comfort, and similar) but cannot guarantee the fulfillment of such a request, and also the service executor can charge for such an additional request on the spot from the Traveler, about which the traveler will be informed by the service executor.

2.15. Reclamation i.e. Complaints

2.15.1. The traveler must point out irregularities i.e. deficiencies in the provision of contracted services on the spot with a reclamation statement to the tour leader, the representative of the Organizer, i.e., the representative of another travel organizer organizing the tourist package, the direct service provider, i.e., an authorized local agency. In the event that, depending on the content, the reclamation could have been resolved on the spot (for example, unsatisfactory room cleanliness, equipment, room position, etc.), and the traveler did not complain on the spot and did not inform the above-mentioned persons about the irregularities, it is considered that the traveler agreed with the service provided in such a way and thereby lost the right to subsequent submission of reclamations with a request for price reduction i.e. compensation for damages. Gulliver Destination Management Company d.o.o. will not consider reclamations if the traveler did not attach the record of the organizer's representative i.e. service provider about the reclamation from which it results that the deficiencies could not be resolved on the spot.

2.15.2. Reclamation procedure: the traveler must reclaim the inappropriate service to the representative of the organizer immediately on the spot, and in their absence to the service provider. In removing the cause of the reclamation, the traveler should cooperate with the representative with good will. If the traveler does not accept offered solutions for the cause of the reclamation that correspond to the contracted services, the Organizer will not take into account subsequent requests for cost refund or reduction of the travel price. If the cause of the reclamation cannot be removed, the traveler will compose a written report with the representative. After returning from the trip, the traveler must, within 8 days from the end of the trip, send a written reclamation by registered mail to the address: Gulliver Destination Management Company d.o.o., Obala pape Ivana Pavla II 1, 20000 Dubrovnik, or to the email address: info@gulliver-dmc.hr and attach evidence regarding the groundedness of the reclamation, and at least: a written confirmation with the signature of the representative or service provider, invoices connected with additional costs and similar. The traveler can also address the reclamation to the point of sale where they concluded the travel contract. The Organizer is obliged to respond in writing to the traveler within 15 working days from receiving the reclamation. During the period until the Organizer's response to the reclamation, the traveler is not authorized to submit complaints or requests to third persons and competent institutions or make information connected with the reclamation publicly available.

2.15.3. When Gulliver Destination Management Company d.o.o. is not the responsible travel organizer, it will forward the reclamation to the responsible travel organizer and inform the traveler in writing of what has been done.

2.15.4. When the Organizer acts only in the role of an informator, the traveler must report all reclamation requests on the spot to the actual direct provider of the relevant service.

2.15.5. Without a written reclamation, the Organizer will not consider requests for price reduction or compensation for damages. A reclamation sent by mail must be signed, and every traveler can submit it in their own name or authorize a third person in writing for that.

2.15.6. The traveler has the right to a price refund or compensation for damages in the amount of the actual value of the unperformed service. This provision does not apply to cases when the Organizer has the right to cancel the package or change the program, in accordance with applicable rules. The limitation of responsibility is valid for all trips for which a travel contract was concluded. The traveler has no right to compensation for lost profit nor compensation for non-material damage and costs arising from it.

2.15.7. For damages that are not the consequence of bodily injury or for damages that the Organizer did not cause intentionally or through negligence, the Organizer is responsible to the traveler up to the amount prescribed by paragraph 2 of Article 45 of the Act on the Provision of Services in Tourism. If international conventions binding the European Union or legal regulations based on them limit the scope of compensation for damages that a travel service provider which is part of a package arrangement is obliged to pay or limit the conditions under which they are obliged to compensate that damage, in that case the same assumptions, limitations, and exclusions apply appropriately to the Organizer and they can invoke that in relation to the traveler. Compensation for damages or price reduction to which the traveler is entitled are subtracted from each other.

2.16. Protection of Personal Data

2.16.1. Gulliver Destination Management Company d.o.o. keeps all received personal data about travelers in accordance with the Personal Data Protection Act and other applicable regulations. It is considered that the traveler, by signing the travel contract, gives consent for the processing of personal data for the purpose of concluding and fulfilling the contract. By accepting these general terms, the traveler simultaneously gives consent to Gulliver Destination Management Company d.o.o. for transferring personal data to authorized third persons, as well as consent that the traveler's personal data can be used for the following purposes: direct sale, market research, conducting business analyses, customer segmentation, statistical processing, and informing about the offer of Gulliver Destination Management Company d.o.o. and its business partners. If the traveler does not want to give such consent, they must declare so during registration for the trip.

2.16.2. The traveler gives personal data voluntarily. Traveler's personal data are necessary in the process of realization of contracted arrangements and will be used for further communication. Gulliver Destination Management Company d.o.o. undertakes not to take the traveler's personal data out of the country except for the purpose of the realization of contracted arrangements. The exception to giving personal data to third persons refers to contracting travel insurance policies, i.e., if the traveler concludes an insurance policy, then their personal data will be forwarded to the insurance company. Traveler's personal data will be kept in a database, in accordance with the Decision of the Management of the company on the manner of collecting, processing, and keeping personal data. The traveler agrees that their personal data as well as photographs and video works collected during the trip in the realization of Gulliver Destination Management Company d.o.o. can be used for the purpose of the realization of contractual arrangements and marketing actions of Gulliver Destination Management Company d.o.o. In order to always have accurate traveler data at the moment when you need our service or other information, please inform us if a change occurs in your personal data or if you made a mistake when entering them. If you notice that Gulliver Destination Management Company d.o.o. does not act according to these principles or you have any other remark connected with the manner of business, inform us at info@gulliver-dmc.hr and we will use all economically justified efforts to investigate and correct the problem as soon as possible. Gulliver Destination Management Company d.o.o. pays special attention to the protection of the personal data of its clients, in accordance with best business practice and valid Croatian and European regulations, including the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council). The goal of this policy is to provide all interested parties with all necessary information about the manner of processing and protection of personal data and the rights clients have regarding the processing of personal data. The policy is applied to all personal data of clients that Gulliver Destination Management Company d.o.o. collects and processes and data collected and processed by its partners. A client is considered to be a person who sought a service or an offer for a service from Gulliver Destination Management Company d.o.o.. Personal data is every piece of data referring to an individual whose identity is determined or can be determined (Article 4 of the General Data Protection Regulation). Data processing means every procedure or set of procedures performed on personal data or on sets of personal data (Article 4 of the General Data Protection Regulation).

2.17. Guarantee Insurance

2.17.1. In accordance with regulations, in case of insolvency or bankruptcy of the responsible travel organizer, the traveler found on a trip, as well as persons who paid advances for the trip, should contact the insurer indicated in the Travel Contract in the fastest way.

2.17.1.1. INSURANCE FOR THE CASE OF INSOLVENCY OR BANKRUPTCY OF THE TRAVEL ORGANIZER. In accordance with the Act on the Provision of Services in Tourism, Gulliver Destination Management Company d.o.o. has concluded an Insurance Contract with the insurer for the case of insolvency or bankruptcy of the travel organizer because of which the travel service is missed, i.e., for the purpose of compensating the costs of returning the traveler to the place of departure. In the event of an insured case, the traveler should contact the insurer in the fastest way: Euroherc osiguranje d.d., Ulica grada Vukovara 282, 10000 Zagreb, PIN (OIB): 22694857747, E-mail: du@euroherc.hr, tel: +385 (0)20 352 700, policy no. 804550929 (professional liability insurance policy number), and Euroherc osiguranje d.d., Ulica grada Vukovara 282, 10000 Zagreb, PIN (OIB): 22694857747, E-mail: du@euroherc.hr, tel: +385 (0)20 352 700, policy no. 804554261 (guarantee insurance policy number for tourist package arrangements). This document is valid as a Confirmation of insurance for the case of bankruptcy or insolvency of the travel organizer.

2.17.1.2. LIABILITY INSURANCE. In accordance with the Act on the Provision of Services in Tourism, Gulliver Destination Management Company d.o.o. has a Contract with the insurance company Euroherc osiguranje d.d., concluded on liability insurance for damage caused to the traveler by non-fulfillment, partial fulfillment, or improper fulfillment of obligations, policy number 804550929. The agency's employees will familiarize the traveler with the content of the valid Liability Insurance Contract for damage caused by Gulliver Destination Management Company d.o.o. to the traveler by non-fulfillment, partial fulfillment, or improper fulfillment of obligations referring to the package arrangement, and the traveler, by signing the Travel Contract, confirms being familiar with the content of the said Insurance Contract.

2.18. Special Conditions of the Arrangement

2.18.1. Gulliver Destination Management Company d.o.o. may determine special conditions of the arrangement for individual types of travel which will be applied to the relationship between the Organizer and the traveler regarding such an arrangement to the extent to which the special conditions of the arrangement are different from these General Terms.

2.18.2. TRAVEL WITH CHILDREN. In individual cases, determined by an individual program of the tourist arrangement, it may be determined that minor children up to the age determined by the program, who travel accompanied by two adults, have discounts on individual services within the overall tourist arrangement or on the overall arrangement. Conditions and the amount of the individual discount are determined by every individual package arrangement program. If special discounts for minor persons traveling accompanied by adults are not provided for in an individual program, then that package arrangement does not provide for special discounts of that type. Every child, regardless of age and the amount of potential discounts, must be indicated in the travel contract and must have valid travel documents necessary for entry into the states in which or through which the travel takes place. If a child is not indicated in the travel contract or voucher for an individual package arrangement, it is considered that the child does not have the right to travel within the framework of that package arrangement.

2.18.3 TRAVEL OF PERSONS OVER 65 YEARS OF AGE. The pace of travel is not adapted for persons over 65 years of age and accordingly Gulliver Destination Management Company d.o.o. is not in a position to positively process such inquiries.

3. FINAL PROVISIONS

3.1. These General Terms and travel instructions exclude all previous travel terms and instructions. General Terms and travel instructions are an integral part of the contract which the traveler concludes with Gulliver Destination Management Company d.o.o., i.e., the authorized travel agency where they registered for travel organized by Gulliver Destination Management Company d.o.o. The parties undertake to resolve possible disputed cases amicably. If that is not possible, in case of a dispute, the court in Dubrovnik is competent, and Croatian law is applied.

3.2. In case of a dispute between the parties, the actually competent court in Dubrovnik is competent and will apply the substantive law of the Republic of Croatia.
